Thank you for choosing PromptMix ("we", "our", "us"). Please read these Terms of Service ("Terms") carefully before accessing or using promptmix.io and any related sub-domains, mobile applications and services (collectively, the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) and capable of forming a binding contract to use the Service. If you use the Service on behalf of an organization, you affirm you have authority to bind that organization to these Terms.

2. Accounts & Security

1. When you create an account, you agree to provide accurate information and keep it updated.
2. You are responsible for safeguarding your credentials and all activity under your account.
3. You must promptly notify us of any unauthorized use or security breach.

3. Subscriptions & Payments

Certain features are offered on a paid subscription basis ("Pro"). Prices, billing cycles and renewal terms are disclosed at checkout. All fees are non-refundable except where required by law.

4. Intellectual Property

The Service—including all software, design, text, graphics and logos—is owned by PromptMix or its licensors and is protected by intellectual-property laws. Except for the limited license expressly granted to you, we reserve all rights.

5. User Content

1. "User Content" means prompts, text, images or other data you upload to the Service.
2. You retain ownership of your User Content. By uploading, you grant us a worldwide, non-exclusive license to host and display it solely for operating the Service.
3. You represent that you have all rights necessary to upload the User Content and that it does not violate any law or third-party right.

6. Acceptable Use

You agree not to:

• Reverse-engineer or bypass any security or rate-limiting mechanism;
• Interfere with or disrupt the Service;
• Use the Service to produce unlawful, harmful or discriminatory content;
• Misrepresent your affiliation with any person or entity.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTMIX DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROMPTMIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTly, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify and hold harmless PromptMix and its affiliates from any claims, losses and expenses arising out of or related to your use of the Service or violation of these Terms.

10. Modifications

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or create risk for us or other users.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Wilmington, Delaware.
